A whole unmarked toothpick was found lodged in his digestive track and had punctured his  duodenum during emergency surgery and following an eight-inch abdomen incision. The major issue in this case was causation, lack thereof and burden of proof of issues. Obtained a unanimous jury verdict that was upheld by the California Court of Appeal in an unpublished decision.
